インターネットを通じて日本のテレビ番組を海外などで視聴できるようにしたサービスを巡る２件の訴訟の差し戻し審で、知財高裁は３１日、ＮＨＫと民放各社の請求を認め、いずれもサービスの停止を命じる判決を言い渡した。


　飯村敏明裁判長は「テレビ番組を録画・送信していたのは個人利用者ではなく、機器を管理していた業者で、著作権侵害と認められる」と述べた。

　問題となったのは、海外の加入者から有料で預かった市販の送信機器で番組をパソコンに転送する「まねきＴＶ」と、顧客に貸し出した録画・配信機器「ロクラク」で番組を転送するサービス。判決は、まねきＴＶを運営する永野商店（東京）に約１６６万円の賠償を、ロクラクを提供する日本デジタル家電（浜松市）には約１５７０万円の賠償と機器の廃棄も命じた。
